Deferred Action for Childhood Arrivals (DACA)

Litigation around the DACA program continues. Existing DACA holders, including DACA holders whose status expired LESS than one year ago, may continue to renew their status.  


  • You may renew your DACA if you previously held (expired less than one year prior) or currently hold DACA status under the pending litigation.

  • We will continue to charge $300 to process DACA renewals without complications. The USCIS filing fee is $495, and will raise to $605 as of April 1, 2024.

  • Individuals who never held DACA (or held the status but let it expire more than one year before) but meet the 2012 guidelines are not recommended to apply for the first time as all new applications are being held indefinitely pending litigation.

  • DACA holders can apply for advance parole if they are eligible based on a humanitarian, work, or education-related reason.

  • We strongly encourage eligible applicants to apply for advance parole if they are eligible and to discuss with your attorney the possible future immigration benefits that stem in some circumstances from a parole re-entry

VERY IMPORTANT - if you have possible other relief available to you - through a United States citizen or lawful permanent resident spouse, another family petition, a U visa (have you ever been the victim of a serious or violent crime?) please talk to one of our attorneys as soon as possible.
